No Retrial For The Pirate Bay Case

A Sweedish court today rejected the Pirate Bay's inquiry for a retrial after claiming that the judge of the trial earlier this year as biased. The Svea court today ruled that there are legitimate doubts about the judge's impartiality in the Pirate Bay's case and that there has not been any bias.

The founders of the Pirate Bay web site were found guilty last April at the Stockholm district court, which had ordered the four involved in running popular BitTorrent tracker to pay US$3.6 million in damages.

After receiving a verdict, the Pirate Bay defendants charged the judge with bias and asked a court of appeal for a completely new trial with a different judge. The defendants claimed that specific judge had been a member of several of the same copyright protection organisations as several of the main entertainment industry representatives.

Although the defendants cannot appeal the latest rulling of the Sva court, they are expected to appeal the results of the first trial.
