Damaged? in what way?

Some drives certainly don't seem to agree with it, and reverting back is tricky.

BS41 was "pulled", and though "they said 4x DL, but forgot to enable it", is one supposed reason, would that be a big enough problem to withdraw it for?

Every 1 on 5 DVD's or CD's that I put into the drive start to make a scratchy noise like if the DVD was just flying loose in the drive, no grip at all, just spinning madly.

That BS41 was a disaster for my burner, first of all not 1 DVD got burned well, all unreadable afterwards. secondly when I wanted to test to write a DVD-R at 12x it made such an incredible noice of scratching that I thought the drive was gonna break in a thousand pieces.

So no thanks, I stick back to BSOS, but like I said the scratchy noice is not gone so I guess the drive will break sooner or later .... just lucky I still have warranty.

Maybe a difference between a US 1633s an an european??

No there is no difference, the problem was not with the firmware, I imagine that you have a defective drive. I would not wait to return it, I would do so straight away.
