Prassi Asks Court To Expand Adaptec (ADPT) Antitrust Case

"...Prassi Software USA, Inc. today announced that on November 27, 2000, it will be applying to the San Jose Federal District Court in San Jose for permission to broaden Prassi's antitrust lawsuit against Adaptec, Inc. to assert expanded antitrust claims and to include Roxio, Inc., the corporate successor to Adaptec's Software Products Group, as a sued party. Prassi also announced a clarification of its October 11, 2000 Press Release, "Prassi Pursues Antitrust Case Against Adaptec After Settlement of Contempt Charges" to correct any impression created there that Prassi will be suing Tom Shea and David Ulmer as individuals.

As reported in the October 11 Press Release, Prassi instituted antitrust litigation against Adaptec in 1998. This litigation, as originally framed, asserted claims against Adaptec and Adaptec executives Tom Shea and David Ulmer. The current version of the antitrust lawsuit against Adaptec does not name Mr. Shea as a party, and Prassi is informed that Mr. Ulmer has now left Adaptec. Under the circumstances, Prassi no longer intends to pursue antitrust claims against either of these individuals. Accordingly, Prassi will not ask the Court on November 27 to have Mr. Ulmer or Mr. Shea named in the antitrust lawsuit as sued parties, although both are expected to testify in the matter.

When reached at Prassi's offices, Prassi's President, Umberto Bassignani, stated, "Adaptec's anticompetitive behavior is what our antitrust lawsuit is all about. We want the Judge and Jury to focus their undivided attention on Adaptec, and now Roxio, to remedy what they have done, and not specifically on Mr. Shea and Mr. Ulmer." .."
