 Princo not influenced by loss in litigation with Philips

Message Text: According to DigiTimes, Princo will not substantially influence its business operations.

For the same patent infringement, Philips also sued Princo and Gigastorage at the International Trade Commission (ITC) in mid-2002 and lost in ITC's preliminary judgment in October 2003 and final judgment in March 2004, Princo indicated. The Court of Appeals for the Federal Circuit (CAFC) is in charge of appeals against judgments by both ITC and the district court, and is expected to make its final decision in June or July this year, Princo said.

According to cases recorded in the past two years, CAFC has never reversed ITC final judgments, Princo emphasized. Therefore, Princo has no way to predict CAFC's final decision but expects CAFC to uphold the ITC's final ruling, the company pointed out. In addition, Princo's exports of CD-R/RW discs to the US account for only 5%-6% of its total shipments, the company noted.

Gigastorage has also made statements saying that its US shipments are very low so the judgements do not influence the company's profits.
